The letter

Danny and I have received not one, but TWO letters from the Homeowner's association stating that we are "not properly maintaining our Lot. Please treat for weeds, keep grass cut and maintain your lawn on regular basis per your community guidelines to avoid any further violations." Now, don't get me wrong, our lawn does not look like the fairway at the Master's but we certainly don't have the worst. We keep in line with our immediate neighbors, if not doing a better job that the immediates, and they did not receive a letter. Danny and I really don't get it. I think it started when we went out of state to my grandfather's funeral and did not cut the grass while we were gone. We get back and of course cut the grass, not knowing Big Brother was going to come down with the first letter a week later. So, it frustrates and embarrasses Danny and I, but we don't think much of it because we are confident that we are doing a good job with our yard. We have been champions of the HOA in an area where some of our neighbors think they are the devil-incarnate. We have always paid our dues on time and Danny even served on the board for a year. So, Danny does a second round of regular cutting, trimming, etc since the first letter and I also plant our beds full of annuals, which are all alive and blooming. Then on Friday, boom, letter number 2. WTF????? I ended up calling this morning and the secretary "noted my account" and said she would have the "Senior Community Association Manager" call me. I was polite but really wanted to tell them where they could put their letter.

Did I also mention that the letter stated the following, "Your Board of Directors requests your compliance with this rule and that you discontinue violation of the same. Please note that any further violations of this rule/policy may result in the levying of a Monetary Enforcement Assessment. In addition, the Board of Directors reserves the right to seek other remedies as may be available to it within your governing documents."

Putting on my "I almost went to law school hat"....legally I think that it has stood time and again that HOAs are pretty much impotent.

I would ignore it.

And get a toilet to plant those beautiful annuals in on the front lawn.

HOA's are no different here. Thankfully we don't have one... but our friends do - and they are always telling stories of letters, violations and other issues that EVERYONE in their neighborhood is pestered with. Sorry you're having to deal with them. :)
